PORT OF OAKLAND TO CREATE NEW MEGA-TERMINALTO ENHANCE COMPETITIVENESS

 Port Settles Litigation To Achieve Long-Term Revenue Stability And Jobs

The Oakland Board of Port Commissioners unanimously approved a litigation settlement agreement with SSA Terminals, LLC and SSA Terminals (Oakland), LLC (collectively, “SSAT”), one of the Port’s major long-term seaport tenants. The settlement involves four of the Port’s seven marine terminals, and will create operationally the 3rd largest terminal on the U.S. West Coast. In terms of size and operational efficiencies, this new “mega-terminal” will be more in line with competing terminals, allowing the Port to sustain and attract more maritime cargo, which currently supports approximately 40% of the 73,000 jobs the Port generates annually in the region.

“We reached this litigation settlement to protect the Port’s long-term viability as a job-creating economic engine for this region,” stated Port Board President Cestra “Ces” Butner.

The four terminals involved in the agreement are located along the Inner and Middle Harbors: Howard Terminal (Berths 67-68); Global Gateway Central terminal (GGC; Berths 60-63); Oakland International Container Terminal (OICT; Berths 57-59); and Total Terminals International terminal (TTI; Berths 55-56). Under the settlement, SSAT will lease Berths 57-59 through 2022 at current rates and conditions; terminate its lease for Howard Terminal effective September 30, 2013; and dismiss its lawsuits against the Port. Additionally and independent of the settlement agreement, the TTI lease will be assigned to SSAT through 2016, with one option to extend to 2022.

The settlement involves short-term revenue loss in exchange for longer term revenue growth and stability. Prior to this agreement, the Port was facing the expiration of all four terminal leases along its middle and inner harbors in 2016-2017. Further, those leases all had very short renewal notification periods, leaving the Port vulnerable in the event one of the operators decided not to renew its lease. The settlement and the independent assignment of the TTI terminal lease to SSAT create a 350-acre mega-terminal, which is far more optimal than several smaller terminals in today’s competitive maritime market.

The Board carefully considered over many months how to move forward relative to a potential settlement with SSAT and a reconfiguration of the marine terminals over many months. The Port formed an Ad-hoc Committee of Commissioners Alan Yee, Ces Butner, and Bryan Parker to study and evaluate the alternatives available to the Port for settlement. These Commissioners and staff dedicated countless hours to this important endeavor. Given the realities of the Port’s current market position and growing competition in the maritime industry, this agreement provides the Port with important competitive benefits and future opportunities that will facilitate the efficient flow of cargo through these terminals.

Commission President Butner added: “This is a fair deal and creates a lease in line with current market realities. This agreement, along with other transformative projects like the City/Port Oakland Army Base redevelopment, is key to long-term economic growth in and around the Port because it will make us a more competitive gateway.”

He joined the Port of Long Beach in September 2006 as one of four Managing Directors; he oversaw the Port’s Trade Relations and Port Operations Bureau. Prior to his Port of Long Beach tenure, Mr. Lytle served as Vice President of West Coast Operations for the French-based shipping line CMA CGM, which has significant maritime and terminal operations at the Ports of Long Beach, Oakland, and Seattle. Mr. Lytle has also held executive positions at P&O Ports North America, Denmark-based APM (Maersk) Terminals, and Sea-Land Service, Inc., where he was based in Oakland from 1992-1995. Mr. Lytle holds an MBA from the University of Puget Sound and a Bachelor’s Degree in Business Administration from Central Washington University. Under Mr. Lytle’s leadership, the Port of Long Beach worked with the 2nd and 3rd largest global container lines, Mediterranean Shipping Company and CMA-CGM, to establish the Port of Long Beach as their Southern California hub. The resulting realignment of terminals and services for those lines gave the Port of Long Beach an additional 900,000 containers and an estimated $22 million per year. He also worked closely with OOCL, a Hong Kong-based line, to negotiate a $4.5 billion 40-year lease with the Port of Long Beach – the largest lease in US container terminal history. When completed in 2019, the Middle Harbor Terminal will be the most state-of-the art container terminal in the world. Mr. Lytle was also instrumental in implementing numerous ground-breaking environmental initiatives that resulted in 75% reduction in diesel particulates in only five years. Under Mr. Lytle’s leadership, the Port of Long Beach also continued to win the designation as North America’s Best Seaport, a recognition it has earned 16 of the last 18 years, as based on an annual survey conducted by Cargonews Asia shipping trade publication. While in Long Beach, Chris Lytle prioritized community awareness, support and interaction with the activities of the Port. Under his leadership, innovative programs helped make the Port a welcomed partner in the community. Harbor tours, rail tours, and the very well-received “Let’s Talk Port” series in the community educated the public about the Port’s beneficial initiatives and further established the Port’s role as an integral part of the local community and economy. Chris Lytle is expected to begin his service as Executive Director of the Port of Oakland in July 2013. Federal grant for Port’s first phase rail project to boost regional economy


Oakland, Calif. — July 9, 2012 — US Secretary of Transportation Ray LaHood and California Governor Edmund G. Brown Jr. visited the Port of Oakland Army Base redevelopment site Monday, July 9, 2012 to see where the Port will be constructing the first phase of its rail project that received $15 million in federal TIGER grant funding. The $15 million is from the fourth round of the Transportation Investment Generating Economic Recovery (TIGER) grant program (FY2012).

The Outer Harbor Intermodal Terminal (OHIT) Rail Access project of the Port of Oakland will improve rail access to and from the Port and expand the Port’s rail capacity, leading to faster and cleaner goods movement in Northern California, while also providing vital rail access for the proposed Oakland Army Base redevelopment. These federal funds, along with additional local and state funding, will support this critical transportation project.

“This $15 million grant from the federal government boosts state and local efforts to create thousands of jobs by investing nearly $1.5 billion in Bay Area transportation projects. We’re not just rebuilding our infrastructure – we are also rebuilding our middle class,” stated Governor Edmund G. Brown Jr.

The Port of Oakland handles 99% of all containerized goods in Northern California and is the only major U.S. West Coast container port that handles more exports than imports.

“I am very pleased this federal funding we fought for is coming to the Port of Oakland, where it will create jobs and make important infrastructure improvements.  The Port of Oakland’s ship-to-rail exchange project is an excellent investment of federal funds in local and national economies because it both creates jobs and it improves critical public infrastructure in the Bay Area,” said Congresswoman Barbara Lee.  “This $15 million TIGER grant for the Port of Oakland is a clear example of the success of the TIGER grant program and why we must preserve and protect TIGER grants from efforts to end the funding.”

Agriculture represents approximately 40% of the total value of exports through the Port of Oakland, which is the premier export seaport for California agricultural products from the wine country to the Central Valley.

The federal funding will be matched more than one-to-one to launch the first phase of the OHIT Rail Access project, which is part of the joint City-Port OAB redevelopment plan.

“This grant is another giant step forward toward implementing a transformative project at the Port of Oakland which will translate into thousands of jobs for our city and will spur economic growth for generations to come.  We are grateful to Secretary Ray LaHood, the Obama Administration and Congresswoman Lee for their leadership in creating jobs,” stated Mayor Jean Quan.  “The TIGER grant-funded Rail Access project provides a critical link between the new logistics center and the existing port infrastructure making Oakland one of the most efficient ports in the nation.”
This OHIT rail project will deliver greater efficiencies in the Port of Oakland’s rail operations, create additional capacity for cargo movement at the seaport, reduce congestion on local roads and highways, create jobs, and promote sustainable economic growth in the region.
 
The combined City of Oakland redevelopment and the Port’s first phase rail access project on the former Oakland Army Base property is approximately a $500 million investment.  The Port of Oakland is one of only six U.S. ports with a 50-foot deep harbor that can accommodate large container ships.

The Port of Oakland is calling for Request for Proposal (RFP) packages for Aviation Noise Consulting Services (RFP 11-12/05), to be delivered to the Noise/Environmental Compliance Office, Oakland International Airport, Terminal 1, 2nd Floor, 1 Airport Drive, Oakland, CA 94621, until 3:00 PM on June 22, 2012.

The RFP process is designed to select a qualified firm with demonstrated technical expertise and experience in providing aviation noise consulting services to a major commercial airport.  The qualified firm must have extensive experience (minimum of six years) in working with regulatory agencies and scientific organizations related to noise standards and aircraft operations, demonstrated command of the local and national regulatory environment, understand the latest industry trends and policy directions, and demonstrated ability to communicate effectively with the public.
